Terms of Service

These Terms of Service ("Terms") govern your access to and use of Boostify's websites, applications, and related services (the "Services"). By creating an account, clicking to accept, or using the Services, you agree to these Terms. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity. Questions: support@boostify.ai. 1. The Services
Boostify helps marketing and growth teams connect advertising and commerce platforms, synchronize performance and catalog-related data where supported, visualize analytics, and use creative and automation features. Features may change as we develop the product. Certain capabilities depend on third-party platforms remaining available and on you maintaining valid authorizations.
2. Eligibility and accounts
You must be legally able to enter a contract in your jurisdiction. You are responsible for the accuracy of registration information and for safeguarding credentials. Notify us promptly at support@boostify.ai if you suspect unauthorized access.
3. Third-party platforms (including Meta and Shopify)
The Services interoperate with third-party platforms you choose to connect (for example Meta/Facebook/Instagram marketing APIs, Shopify, Google, TikTok, Pinterest). When you connect an account, you instruct Boostify to access and process data available under the permissions you grant. You represent that you have all rights and consents needed to connect each account and ad asset.
Your use of those third-party services remains subject to each provider's terms and policies. Nothing in these Terms overrides Meta's Platform Terms, Shopify's API terms, Google's terms, or similar agreements between you and the provider. If a provider revokes access or changes APIs, affected Boostify features may degrade or stop.
Meta Platform Data. Where you connect Meta (Facebook or Instagram marketing surfaces), our collection, use, retention, and your rights are described in our Privacy Policy. You agree to provide accurate information we reasonably need to honor privacy requests and to cooperate in good faith so we can meet Meta's developer obligations. Meta may retain data under Meta's own policies independently of Boostify.
4. Acceptable use
You agree not to:
- Violate law, infringe intellectual property, or misuse personal data.
- Attempt to gain unauthorized access to the Services, other users' data, or underlying systems (including probing, scanning, or circumventing security).
- Reverse engineer, decompile, or disassemble the Services except where applicable law prohibits that restriction.
- Use the Services to send malware, spam, or deceptive campaigns, or to misrepresent ad or commerce performance.
- Resell or sublicense the Services without our prior written consent, or use the Services to build a competing service by systematically scraping or harvesting our UI or APIs beyond normal permitted use.
5. AI-generated and automated outputs
Features that invoke generative models may produce inaccurate, incomplete, or inappropriate content. You are responsible for reviewing outputs before use in advertising or public communications and for complying with advertising disclosure rules in your markets.
6. Fees, trials, and payment
Paid plans, usage-based charges, and taxes (if applicable) are presented at checkout or in your order documentation. Billing is processed by our payment processor (Stripe). Failure to pay may result in suspension or termination of paid features. Unless stated otherwise, fees are non-refundable except where required by law or explicitly offered in writing.
7. Intellectual property
Boostify and its licensors own the Services, including software, branding, templates, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription or access period. You retain ownership of your own content; you grant Boostify a license to host, process, transmit, and display your content as needed to provide the Services.
8. Confidentiality and beta features
Non-public information we share about roadmaps, pricing experiments, or unreleased features is confidential unless marked otherwise. Beta or preview features are provided as-is and may change or be withdrawn without notice.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE LOSS-FREE. ADVERTISING AND REVENUE METRICS DEPEND ON THIRD-PARTY REPORTING; WE DO NOT GUARANTEE THEIR ACCURACY OR COMPLETENESS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER BOOSTIFY NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THAT PERIOD (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED BY LAW.
11. Indemnity
You will defend, indemnify, and hold harmless Boostify and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your content, your integrations, your violation of these Terms, or your violation of third-party rights or laws.
12. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the Services, non-payment, or legal requirement. Upon termination, your right to use the Services ceases; provisions that by their nature should survive (including intellectual property, disclaimers, limitations, indemnity, and governing law) will survive.
13. Export and sanctions
You may not use the Services if you are located in, under the control of, or a national or resident of any country or entity subject to comprehensive U.S. sanctions, or if you are on any restricted party list maintained by the United States or other applicable government.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules that would apply another jurisdiction's law. Subject to mandatory consumer protections in your country, exclusive jurisdiction and venue for disputes will be the state and federal courts located in Delaware, USA, and you consent to personal jurisdiction there. Before filing a claim, the parties agree to attempt in good faith to resolve the dispute informally for thirty (30) days.
15. Changes
We may modify these Terms by posting an updated version and changing the "Last updated" date. If a change is material, we will provide additional notice where legally required. Continued use after the effective date constitutes acceptance of the revised Terms.
16. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Boostify regarding the Services and supersede prior oral or written understandings on this subject.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- No waiver. Failure to enforce a provision is not a waiver.
- Severability. If a provision is invalid, the remaining provisions remain in effect.
